Arizona Police Board Clarifies Cops to Use CBD Products

With the upscaling CBD market and its products spread across the entire U.S., law enforcement officials are expressing their concerns over the subject of safety of these CBD products. The rise of CBD products poses another interesting question in law enforcement circles:

How should police departments in Arizona respond and address aspiring cops who admit using or test positive for CBD (cannabidiol), the active ingredient in cannabis known for its healing capabilities?

CBD or cannabidiol is a compound derived from the hemp plant, a cannabis genus plant, which has non-psychoactive and anti-inflammatory properties. It is found to be effective in treating pain, acute aches, inflammation, swelling, irritation and improving mental health conditions such as stress, depression, anxiety, seizures, epilepsy and sometimes even life threatening ailments such as cancer and Alzhiemr’s.

The federal government of the United States legalized hemp derived CBD under the Farm Bill in December 2018. It removed the compound from the list of Controlled Substance Act, thereby making it legal for recreational and medicinal use. The maximum allowed concentration for THC, as per the federal standards is measured at 0.3% per unit.

THC or tetrahydro cannabinoid is another compound found in hemp plants that has psychoactive capabilities. It is this compound that is responsible for the “high” that people get while smoking weed.

Nevertheless, the board that regulates police certifications in Arizona has historically regarded the use of over-the-counter CBD based products – such as balms for aches and pains – the same as pot you would find in a medical marijuana dispensaries.

But this changed on June 19, when the Arizona Peace Officer Standards and Training Board (AZPOST) issued a statement clarifying that it does not view the use or possession of over-the-counter CBD based products as constituting the illegal use or possession of marijuana, a dangerous drug, or a narcotic drug.

This came in as a sigh of relief to many.

Matt Giordano, the executive director of AZPOST, said that CBD has been widely discussed since he started his job in 2018. In a memo that explained the policy directive, Giordano said that future law enforcement officers using CBD products are not trying to get blitzed.

Retrospecting the stigma associated with marijuana and its derivatives, it is definitely a progressive move by the Arizona officials to acknowledge would-be officers who have a history of using CBD based products. Most of the people use CBD products for their medicinal value and not any other “getting high” experience as the THC rates are monitored.

Giordano said that police agencies have seen an increase in the number of applicants that have revealed the use of CBD based products during their backgrounds. He further elaborated that the candidates are not using CBD products to get intoxicated, rather it is just a rub of a product containing CBD oil on their elbow or knee before going for a run.

However, CBD products containing more than 0.3% THC that were purchased at a dispensary would be considered illegal and not fall under the exemption. AZ Post will continue to prohibit marijuana products that are above the specified THC threshold.

The 2018 Farm Bill signed by President Donald Trump has led to the proliferation of over-the-counter CBD products. From gummy bears, candies, chocolates, burgers, pizza. Coffee, tea, cocktails, beer to topicals, creams, ointments, oils, facemasks, CBD is now being used in an array of consumer based products.

Not only the market is flourishing with such products, there is a significant decrease in the number of opioids sold at pharmaceuticals. Many people have started using CBD as an alternative to medical prescription for sleeping problems and other issues that were not effectively treated by regular prescriptions.

In an email, Giordano admitted that his office could not identify any cases in which a cop was denied certification for CBD use.

The inhibitions about CBD have also raised questions on the other side of law enforcement in Arizona. In October, Phoenix New Times published a report revealing that the Yavapai County Attorney’s Office charged 2 people with marijauna possession in 2017 for having CBD oil.

One of the charged people, Robert Stapleton, tried to explain to the Prescott Valley office who had pulled him over how the CBD vape pen was different from the illegal, marijuana based products containing higher concentration of THC.

The cop called a deputy attorney to clarify on how he should handle the case, and to the surprise of Robert, the prosecutor said to treat the CBD as marijuana instead of a narcotic.

UAE has some strict regulations against CBD and any other constituent of it. CBD, on the other hand, is anti-inflammatory and also has THC to the tune of 0.3% which is below the legal ceiling. The federal government has not yet legalised CBD in its fullest forms although many states have embraced it through their separate laws. But CBD globally has made an impact considering just about everyone wants to engage themselves in the business of CBD. Likewise, UAE also has drawn a line and has regulated that carrying any product containing CBD is illegal and will be exposed to further charge. The relevant notifications have gone to the foreign office of Britain who has issued guidelines proclaiming the same. CBD has gained immensely in popularity and over the years has been omnipresent in several products like snacks, skincare and medicines which are sold legally in the UK. If by any chance a tourist enters the UAE premises and carries any such substance that is found to be not allowable under their narcotics act they will be asked to get a valid approval letter to carry it further. Many people take CBD oil content in their medicines and it has helped them immensely. For epileptic patients especially, treatment with medicines containing CBD has indeed worked wonders. You will also find people who vouch for it in the treatment of cancer and Alzheimer’s. People with psychosomatic disorders like depression and anxiety also have benefitted a lot from it. The fact that you take medicines containing CBD makes you feel better is true because people think it gives you a high which is not true.

Hence it is advisable that in such state of affairs people do not carry any product that might hold them in contempt. Immigration attorneys who are fighting for different cases related to the issue advice against carrying such products because it is very hard to get by the laws in a country like UAE especially.

With better material to review, CBD is awaiting its turn to become more applicable everywhere. It is now incumbent upon scientists and researchers to undertake studies that will help support their cause. While Marijuana is high on THC which is the psychoactive compound causing a high, CBD has less than 0.3% of THC which does not lead to intoxication converting into addiction. Mrs Gray had spent about 8000 pounds on importing medical cannabis from Holland. This she sourced through private prescriptions whereby she was able to get a hand on two types of CBD oil which helped ease her son’s symptoms of astatic epilepsy. She is a constant crusader for allowing doctors to prescribe medical cannabis for patients like her son who are suffering a lot. She had started importing the oil and within a few days of usage, she found the difference.

In August 2018, Murray legally received the first drug Epidiolex that contained CBD. Initially, she couldn’t believe that the medicine worked so effectively. Murray was able to talk, walk and eat but after three months the effect sunk and he got admitted. Karen became panicky when the doctor then prescribed a drug containing THC. Murray’s treatment with the drug was effective because, after the episode, he went 104 days without any seizure. 

Despite such huge improvements in health, she now worries for the inflating amount of 231,000 pounds for all the children together. She intends to submit the invoice of the giant amount to the Department of Health expecting some immediate relief from their side. She also reminisces about their meeting with Matt Hancock over this matter about half a year ago, but ever since nothing has been done to help them. Hence they are demanding that Boris Johnson immediately intervene and take up the matter in his hands. 

CBD has certain which have found to be extremely useful for treating symptoms of a seizure. Apart from seizures, it has been found that CBD also has been effective in treating joint pains, extreme pains after injury, recovery pains, emotional disorders like depression and anxiety, Cancer and Alzheimer’s. A new wave of CBD is flowing everywhere and researchers all over the world are doing their best to make the best use of studies to establish its benefits.

Karen is expecting the Scottish government to help her and other similar cases. She intends to get funded for the medicines by the government unless the doctors start prescribing the drug by themselves. Lib Dems MP Christine Jardine expressed discontent that government is keeping mum on the issue and its obduracy is not helping people suffering. 

The drug seriously changed the life of Murray and several others who are receiving treatments. But the costs are a huge mountain that needs to be conquered. She wants the government to keep up the promises that they had made while they assumed office. 

It is surprising that when many countries are legalising buying the drug within their own country, people like Karen have to undertake several measures before sourcing the product. The expensive imports have caused a dent in her savings and the monthly outgoing is as good as the mortgage installments. Like Murray, several lives have been touched by the cannabis drug. But, if the government is unyielding it will never help their cause to benefit the entire community. 

People in these recent years have strengthened their belief and commitment to CBD and cannabis. They are willing to study and read up more about it. The laws are strict now, but with time and more scientific back-up, things could be brighter than they were.
