The Hoosier state has had its fair share of controversies around CBD. So, is it Legal to use CBD Oil in Indiana?

1_Is CBD Oil Legal in Indiana-

Is CBD Oil Legal
in Indiana?

CBD Oil is Legal in Indiana.

1_ any product containing more than 0.3% THC is Illegal

Though it might seem confusing if you look at all different Federal and State laws, since 2018 it has been completely legalized. However, any product containing more than 0.3% THC is Illegal.

Therefore, CBD Oil containing less than 0.3% is Legal in the state of Indiana.

1_What's Legal, What's Not in IN!

What's Legal, What's Not!

CBD oil and other derivatives of the Cannabis sativa plant that contain less than 0.3% of THC is legal in Indiana. THC is the component in marijuana that produces the high, however at 0.3%

it won’t have even the slightest of impact on you.

The law is strict in comparison to other states when it comes to the THC content in the state of Indiana and requires manufacturers to test every batch of their product to ensure that the THC level is less than 0.3%.

1_Senate Bill 52 that brought about this welcome change

This new law has come into effect from July 2018 allowing Indiana residents to possess, consume, buy and sell the CBD oil legally without any restrictions. The only rider as per the Senate Bill 52 that brought about this welcome change is that the labelling on the product being sold has to be correct and that it has been tested and found to contain less than 0.3 percent of THC.

1_CBD product should have a QR code on the label

The bill also mentions that all CBD product should have a QR code on the label that lists the names of all the companies from whom the ingredients have been procured to make the final product.

If you are a registered company and have the specific label requirements in place, you are legally allowed to sell, use and produce CBD oil to any legally approved age person.

But be aware that there are many bylaws to this Senate Bill 52 whose interpretation is still cloudy regarding the usage and consumption of CBD oil and can land you in prison or at least with a hefty fine or maybe both. For instance, if a licensed retailer of CBD oil is found with products having more than the approved percentage of THC, they could have their license revoked as well as get additional penalties. Also, if a retailer is selling CBD oil and also has the normal marijuana in the store for selling, they can face level 5 felony charges that attracts a six-year prison and fines ranging till $5,000. Or if a retailer has packaged marijuana as a low THC CBD oil and is caught, they will have to face Class A misdemeanor charges amounting to $5,000 and up to a year in prison.

1_legally cultivate and grow hemp for legally extracting CBD with less than 0.3% THC

President Trump signed a $867 billion Farm Bill that paved the way for farmers to legally cultivate and grow hemp for legally extracting CBD with less than 0.3% THC.

For many decades Federal Law did not differentiate between hemp and other uses of the cannabis plant which has been illegal since 1937 under the Marijuana Tax Act and made formally illegal in 1970 under the Controlled Substances Act. This Farm Bill legalizes hemp but does not create any system where people may grow it freely. This responsibility is left with the respective State Governments for both personal as well as industrial production. Vice-versa cannabis programs that are legal as per state laws are still illegal under the Federal law.

1_While hemp-based CBD, oil has been given a green chit in Indiana

While hemp-based CBD, oil has been given a green chit in Indiana for the moment, the state still has zero tolerance towards marijuana. Keeping that in mind, one is advised to be very certain of the source of your CBD oil and the THC content before even starting to think about its health benefits.

In case you are wondering, CBD can be extracted from two sources, one is from the legally allowed hemp which is legally allowed without any crime committed and the fear of an arrest. The second method is to extract CBD oil from marijuana which is illegal even if it contains lesser amounts of THC.

1_Recreational usage is not allowed

Recreational use of marijuana or for health purposes of this other variety is completely overlooked by the law and you will be held and charged with breaking the law.

Though the demand for this second variety is astounding from the general public but getting it legally does not seem possible as of date. Many other bills on marijuana legalization have been passed over the years but none of them have been approved.

Indiana has no tolerance for THC and its derivatives and you can get into trouble for having any trace of THC in your blood. Drug tests will generally be unable to pick up CBD oil in your blood but if you are consuming large doses of it, you might get a false positive in the test and be the one who is playing with fire. It is best to ask your healthcare professional as per dosage requirements for your particular health issue and be safe than sorry.

There is much confusion regarding what is legal and illegal in the State which came to the fore when the Greenfield Police Department tested two CBD flowers from two places and concluded after the smell test, micro and macroscopic examinations and the Duquenois-Levine test, one generally used for cannabis testing that the product is undifferentiable from marijuana.

They also employed a canine test to establish the presence of cannabis which many wondered was like asking the dog to differentiate between a rose and a flower. They did not or could not administer a suitable test to check the percentage of THC, which is the major distinctive feature between what is legal and what is not. This would be hilarious maybe for the police to pull one over, identify something like marijuana in your car, search your car, arrest you, and put you in jail.

When later they discover that the THC content is less and so legal, you still would have to pay for your car being towed or have been fined and with an arrest record for which you will need to wait a year before being expunged. The police are immune in this case from civil liability as they cannot differentiate under normal smell and look tests if the CBD item you were carrying was legal or illegal and the damage is done.

CBD is quite openly available in most pharmacies as well as local retailers. CBD oil is available as creams, gummies and most other types of things. Many retail stores and mom and dad shops have started using them as food additives in shakes, purees, cakes, cookies, etc.

Some vape shops have also started stocking CBD with them, some of them in no order of preference are:

  1. Main Street Vapor Shop, Address: 205 E Main St, Brownsburg, IN 46112
  2. Sir Vapes-A-Lot, Address: 1995 E Stop 13 Rd, Indianapolis, IN 46227
  3. Indy E Cigs, Address: 7130 Woodland Dr, Indianapolis, IN 46278
  4. Indiana Vapor Labs LLC, Address: 109 N Chestnut St, Seymour, IN 47274
  5. New Cloud Vapor Vape Shop, Address: 4510 Charlestown Rd #500, New Albany, IN 47150

With many more opening shops almost every day to be a part of this ever-growing CBD health craze.

The only restriction is that the product should contain 0.3% of THC and make sure that you check out the retailer and are certain of them being good business people with ethics as any problems from their end will still land you in trouble. Other than that, yes there is no restriction for you to buy, use, etc. of the CBD oil in Indiana state. To know more about laws in other states visit here

1_Problems with buying CBD locally in IN

Problems with buying CBD locally

Be extra careful when buying CBD oil locally in the state of Indiana as the state has a zero-level tolerance towards THC and its metabolites. Even a small trace of THC in your blood can land you in a heap of trouble. So, do your research

A reliable brand will clearly mark their ingredients along with its recommended dosage. They should also have different products with varying strengths to meet the health needs of their different customers.

However, buying locally has some other problems like:

  • Scams: Reports of CBD Oil containing 0% CBD is widespread
  • Impure CBD Oil: CBD Oil containing other impurities have also been found
  • No third-party lab reports: As local brands and vendors don’t have the scale to be able to routinely lab tested by a third party, most of the times they skip this important step.

It is legal to buy, sell and use CBD oil in Indiana but as per the interpretation of the police department and their clarity on its usage, it gets quite confusing.
