After vociferous opposition from almost all legal departments including Idaho State Police, the Idaho Prosecuting Attorneys Association, ODP, the Fraternal Order of Police, Department of Health and Welfare (DHW), the Idaho Police Chiefs Association, the Idaho Criminal Justice Commission and the Idaho Sheriff’s Association it was almost out of the House on the grounds that:

  1. More lab tests are required
  2. Law enforcement issues
  3. Concerns about the purity of the products
  4. No clarity on product dosage and its interaction with the body in general

For a brief time surprisingly, the Bill was passed the following “lengthy and emotional” hearings.

However it was finally vetoed by the Governor on the basis that it ignored ongoing scientific testing on alternative treatments as well as the fact that it looked past the potential for misuse and abuse with criminal intent. He however, offered a solution by passing an Executive Order for the EAP to provide children with intractable epilepsy better access to pharmaceutical grade CBD, Epidiolex, which is a part of the FDA approved study. 

 

In their defense to the above mentioned rejection in 2015, the Idaho Attorney General cleared that CBD products in general are defined as a Schedule I controlled substances as per the Federal Law and any material, mixture, compound or preparation made from any quantity of either THC or oil extracted from any part of the cannabis plant can be defined as not a controlled substance if the following conditions are met:

  1. The oil extract may not contain any amount of THC. For example, if you have a CBD Oil bottle with THC 0.3% or less, it will be Illegal.
  2. Any oil extracted from the marijuana part of the Cannabis plant will be deemed Illegal as Marijuana is a Schedule 1 controlled substance.

So, any oil extract that contains more than 0% THC or is extracted from Marijuana is Illegal in Idaho.

The 2015 Opinion number 133 also states that in order for marijuana to not to be deemed under Idaho codes 37-2701(t) as a schedule I controlled substance, it must be derived and produced from:

  1. Mature stalks of the plant
  2. Fiber produced from the stalks
  3. Oil or cake made from the seed
  4. Any combination and preparation of the mature stalks
  5. Sterilized seed of the plant which is incapable of germination

CBD or Marijuana related products are Illegal, if they contain any trace of THC, in whatever form and if you are purchasing them even online in the state of Idaho you are breaking the law and are at risk of being prosecuted. CBD products do sometimes contain THC and it is not uncommon to find instances where people have failed drug tests who use CBD oil.
