The Grand Canyon state of Arizona is well known for its natural beauty, but it is also one of the few states where CBD oil is completely legal. There are a few teething issues and slight confusion between the various legal departments on CBD’s formal status. But this slight distress should get corrected soon.

1_Is CBD oil legal in Arizona

Is CBD Oil Legal
in Arizona?

1_whether vaping CBD Oil is legal or not is still up for debate as per Proposition 203

Yes, CBD Oil is absolutely legal in the state of Arizona. However, whether vaping CBD Oil is legal or not is still up for debate as per Proposition 203. Therefore it is best to avoid vaping CBD Oil..

1_What’s legal, What’s not in AZ

What's Legal, What's Not!

In June 2019, Arizona Peace Officer Standards Training Board (AZPOST) clarified that they do not view the use or possession of over the counter CBD products as illegal.

1_They do however prohibit the use of CBD products that contain more than 0.3 percent of THC

They do however prohibit the use of CBD products that contain more than 0.3 percent of THC. This amount of THC in the CBD is also made legal via the Farm Bill 2018 that legalised hemp production across the country and led to the popularity and proliferation of CBD products from chewing gum to oil, candies and topicals to dog treats.

1_r treating epilepsy and that buying CBD oil in Arizona is legal even without a medical marijuana car

This freedom to use CBD came via a court ruling in 2014 that determined that CBD is allowed to be used medically for treating epilepsy and that buying CBD oil in Arizona is legal even without a medical marijuana card, especially for the CBD derived from industrial hemp.

Though purchasing cannabis is still illegal as per Arizona state laws as well as the Federal laws.

And then it goes downhill in the legal sense as growing hemp is against the law in a roundabout manner. You see growing cannabis is illegal as per Federal law and industrial hemp even though it contains less than 0.3% THC is technically speaking, the cannabis plant and hence illegal on the Federal level. But you may possess hemp or import it from outside the state and then use it or even sell it and it is fine from the legal side.

1_You also need no prescription

You also need no prescription, technically speaking to purchase either THC or marijuana products in Arizona state.

The state does have a medical marijuana program that promotes a doctor’s recommendation to apply for a medical card but on the ground it never happens. Doctor’s never prescribe CBD or marijuana to their patients as they risk losing their license for recommending a Federally illegal product. They instead just downplay it by signing on a recommendation and the patient on their own dose, medicate and monitor their progress.

Proposition 203 helped clarify this conundrum by defining a “qualifying patient” as a person with one of the following debilitating medical conditions.

  1. Cancer
  2. Glaucoma
  3. Positive status for human immunodeficiency virus
  4. Acquired immune deficiency syndrome
  5. Hepatitis C
  6. Amyotrophic lateral sclerosis
  7. Crohn's disease
  8. Agitation of Alzheimer's disease
  9. A chronic or debilitating disease or medical condition that produces any of the following:
    1. Cachexia or wasting syndrome
    2. Severe and chronic pain
    3. Severe nausea
    4. Seizures (including those characteristic of epilepsy)
    5. Severe and persistent muscle spasms (including those characteristic of multiple sclerosis)
  10. Any other medical condition added by DHS through a public petition process
1_House Bill 2349 which states that medical marijuana cannot be possessed or used at educational insti

But then as sometimes only the legal eagles do, they brought forth an exception to Proposition 203 in the form of House Bill 2349 which states that medical marijuana cannot be possessed or used at educational institutions.

The roundabout purpose of this ban on educational institutes seems to be to keep under the radar of the FDA and to keep receiving state grants and loans but the public is not pleased with it as they believe, especially the students, that they too have a right to use CBD and medical marijuana to ease their symptoms.

These small wrangles between government agencies and slight confusions notwithstanding, CBD is quite easily available in the State.

Although there is definitely a lacuna in research on CBD products but the various testimonies around CBD are quite invigorating. They are openly available in the state and you are legally allowed to purchase CBD products from anywhere in the form of oils, tinctures, creams, pills and use it to cure everything from inflammation, back pain, anxiety, insomnia, headaches and much more.

1_But be aware of spurious and low grade products

But be aware of spurious and low grade products as this freedom to use CBD products has also brought in some unscrupulous players. Some people who make their CBD products and extract the oil on a DIY basis may have questionable purging methods.

These products may look similar to a good quality product but the results could also be harmful. Some poor grade CBD oils are also being mixed with tap water, vegetable glycerin or propylene glycol to increase their volume and to earn a fast buck.

Some of the most hot selling item is the oral tincture which you place under your tongue and is generally used by customers for overall well being or some other type of whole body issue. FDA however is fining companies who are openly making any health claims that CBD can cure and ailment or a disease as according to them these are not backed by any proper scientific papers. They are also confiscating products of such companies who as per them are not complying with the FDA rules.

1_Horrors of Buying CBD locally in AZ

Horrors of Buying CBD locally

Most local shops will sell you any sort of cannabidiol. The duty of whether they are safe or not in the state lies with you. This was found in a hard way by one resident who was found in possession of a vape of CBD in his pocket when law enforcement officers checked his pockets during a search. The state law is in a flux and against resin extracted from the cannabis plant and with law enforcement not capable of checking whether the CBD one possesses is the legal variety or not, it is like playing with fire from your point of view. Most local stores have no idea about the validity of the sources either unless they have a proper third party testing certificate and buying from such places is surely unsafe.

How to get CBD Oil Online in Arizona

Buying online is faster, convenient and much easier than going through the entire gamut of law enforcement and any other legal problems. Do please check out the company who is offering the product in regards to its quality and its capability to deliver to your address. A third party check by a laboratory is usually a guarantee of the product’s quality. Do please remember to check that the CBD product you intend to buy has less than 0.3% THC and do not buy a vape variety of the product as using it in vapour form is illegal still. Other than that you can get good deals online which will also allow you to obtained CBD oil at a cheaper price.

Final Thoughts on CBD Oil in Arizona

For most intents and purposes it is quite easy to find and use CBD products while you remain within the law in Arizona. Just remember not to smoke these products till the time state laws open up their arms further to allow vapes to be legal as well.
