The House Bill 1518 came into effect in June 2019, which in turn revoked any and all criminal and civil penalties for any possession or usage related offence of any CBD product that has been derived from Hemp, in Arkansas.
HB 1518 also ensures that the federal government does not regulate CBD and any of its products inside the state of Arkansas. In the rest of America, the FDA still bans the usage of CBD for the general public. This bill also gives the residents of Arkansas complete freedom not just to buy, sell, use of any and all CBD products but that too regardless of continued federal prohibition. Without state cooperation, the FDA cannot in effect regulate their ban in Arkansas.
The state of Arkansas has further directions for buying CBD oil made from Marijuana or containing more than 0.3% THC:
- A person needs to be over 21 years to be issued with the medical ID card for CBD oil.
- A person needs to be suffering from one or more of the many health reasons to be issued with an ID card.
- The CBD oil being sold should have less than 0.3% of THC or not over 10mg of THC.
The state also runs a medicinal marijuana program where patients may enlist via the recommendation of a licensed physician. However, possession of marijuana and its products for recreational purposes with or without the medical ID card remains illegal that can attract fines and the offence penalties may go up to around 10 years in prison.
Now for the confusing part of this legislation - CBD oil can be derived from both marijuana as well as from the hemp of the plant. The oil derived from marijuana is, on-paper, illegal as the percentage of THC it contains is more than the permissible levels.
The oil derived from the hemp is completely legal in Arkansas as it falls under the Farm Bill 2014 that legalized the usage and cultivation of industrial hemp. But how does a layman check which oil is from what source?
