Is CBD Oil Legal
in Arkansas?

1_House Bill 1518

Yes! CBD Oil is Legal in Arkansas. In fact, Arkansas was one of the first states to legalize CBD Oil and its derivatives after the signing of House Bill 1518, which removed CBD derived from Hemp, from the State’s list of controlled substances.

However, only CBD Oil made from Hemp and contain 0.3% THC or less has been legalized. For CBD Oil made from Marijuana or containing more than 0.3% THC, read on!

1_What is Legal in AR and what is not-

What's Legal, What's Not!

The House Bill 1518 came into effect in June 2019, which in turn revoked any and all criminal and civil penalties for any possession or usage related offence of any CBD product that has been derived from Hemp, in Arkansas.

HB 1518 also ensures that the federal government does not regulate CBD and any of its products inside the state of Arkansas. In the rest of America, the FDA still bans the usage of CBD for the general public. This bill also gives the residents of Arkansas complete freedom not just to buy, sell, use of any and all CBD products but that too regardless of continued federal prohibition. Without state cooperation, the FDA cannot in effect regulate their ban in Arkansas.

The state of Arkansas has further directions for buying CBD oil made from Marijuana or containing more than 0.3% THC:

  1. A person needs to be over 21 years to be issued with the medical ID card for CBD oil.
  2. A person needs to be suffering from one or more of the many health reasons to be issued with an ID card.
  3. The CBD oil being sold should have less than 0.3% of THC or not over 10mg of THC.

The state also runs a medicinal marijuana program where patients may enlist via the recommendation of a licensed physician. However, possession of marijuana and its products for recreational purposes with or without the medical ID card remains illegal that can attract fines and the offence penalties may go up to around 10 years in prison.

Now for the confusing part of this legislation - CBD oil can be derived from both marijuana as well as from the hemp of the plant. The oil derived from marijuana is, on-paper, illegal as the percentage of THC it contains is more than the permissible levels.

1_Farm Bill 2014 that legalized the usage and cultivation of industrial hemp

The oil derived from the hemp is completely legal in Arkansas as it falls under the Farm Bill 2014 that legalized the usage and cultivation of industrial hemp. But how does a layman check which oil is from what source?

1_CBD from Hemp is allowed in AR

For someone who wants to experience the health benefits of CBD oil without a medical recommendation - CBD oil derived from hemp is the answer.

It is considered an over the counter product and one can buy a bottle of it easily in the state. Although cultivating the plant at home or publicly using cannabis products for recreational purposes is still prohibited under the law.

However, the state of Arkansas is expected to remove these regulations as well. This owing to the HB1518 which states its aims to provide complete access to CBD and all of its related products without any legal issues. Also, Know about CBD Legal status in other states.

1_Horrors of buying CBD Locally in AR

Horrors of buying CBD locally?

Buying CBD Oil locally presents its own set of dangers. This is because when you buy locally, you are relying heavily and solely on your trust for the store. It has been found that local CBD brands don’t have the necessary licenses or authorization to sell. They might also not be aware of the specific guidelines that have been laid by the Government for selling CBD in that particular state. There may also be an issue with the quality of the product, and there is a possibility of the CBD Oil bottle having some impurities.

There have been reports of locally bought CBD Oil, being fake or having a far lower amount of CBD per dollar spent. Low quality CBD oil made from artificial cannabinoids is sold in the stores. They are also not being tested by any third parties while you pay a premium price, sometimes even 5 times of what they are being sold online.

Using such low-grade material is not just unethical on the part of these stores but also does no help to your pain or anxiety or any other health benefit that you may be using the CBD oil. We agree that it is much more convenient to purchase from the local store but with only around two days of delivery waiting time, you can get a much better product at a much lower cost online. However, one should know what they are buying online as well, as the chances of being swindled still depends upon how much information you have.

How to get CBD Oil Online?

Buying online is definitely faster, convenient and much easier than going through the hassle of travelling down to the store, finding a parking and then picking the product you want. But you don’t know the person who is selling the product online and so here are a few tips to figure out if the online brand can be trusted.

Here are some broad points to consider before buying CBD Online:

  • Check for Third Party Lab Reports.
  • Also check for the date on these reports. They shouldn’t too old.
  • Check the CBD per Dollar Ratio that you are getting. Compare with others.
  • Get in touch with their customer support. Gauge if they are genuine from their behavior and their communication
  • Go for 100% Organic Industrial Hemp made CBD, to be completely safe.
  • Check for other reviews from customers
  • Also check for their method of extraction. CO2 extraction is considered the best method for extraction.

When you find a brand that ticks all boxes, you should be able to comfortably buy from that brand. While buying CBD Oil online is definitely the safer option, your due diligence is still necessary.

Final Thoughts on CBD Oil in Arkansas

With the increasing levels of demand buying CBD Oil and its other variants has become quite easy. While the Government is still out contemplating laws on CBD, the users can’t be stopped.

Also, some manufacturers of CBD claim its health benefits as a cure all for all ills, research hasn’t yet been conclusive of those claims. However, CBD has definitely shown improvement for: insomnia, chronic pain, anxiety, depression, muscle spasms and loss of appetite.

CBD is at present easily available in the state of Arkansas as an unregulated supplement and one should learn about the product and its manufacturing process before buying from either the local store or online.
